Terms of Service (ToS)

1. Introduction

Welcome to Top Web Design ("we," "us," or "our"). By accessing our website or purchasing our website-as-a-service plans, you agree to be bound by these Terms of Service.

2. The Service

We provide a subscription-based web design and hosting service. This includes the design, development, hosting, and maintenance of a website based on the package selected (Starter, Business, or Growth).

3. Payments & Subscription

Fees: You agree to pay the monthly subscription fee associated with your selected plan.

Billing Cycle: Payments are collected automatically every month on the anniversary of your sign-up date.

Late Payments: If a payment fails, we will attempt to retry. If payment is not received within 7 days, your website may be temporarily suspended. If unpaid for 30 days, the website may be permanently deleted.

4. Intellectual Property & Ownership

Our IP: During the first 12 months of your active subscription, Top Web Design retains full ownership of the website design, code, graphics, and layout. You are granted a non-exclusive license to use the website while your subscription is active.

Your Content: You retain full ownership of all text, images, and logos you provide to us to place on the website.

Ownership Transfer: Full ownership of the website design and code automatically transfers to you only after 12 consecutive monthly payments have been made.

Early Buyout: If you wish to transfer ownership or move the website to another host before 12 months, you may do so by paying an "Early Buyout Fee" equal to the remaining balance of the first year's payments.

5. Cancellation

Month-to-Month: You may cancel your service at any time.

Effect of Cancellation:

If cancelled before 12 months: Your website will be taken offline, and you will not receive the files/design unless the Buyout Fee is paid.

If cancelled after 12 months: You own the design. Upon request, we will provide you with a .zip folder containing your published site’s content including HTML, JavaScript, CSS, images, and media files. If this is not requested within 30 days, we retain the right to delete all data.

6. Limitation of Liability

To the fullest extent permitted by law, Top Web Design shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from the use of our services or website downtime.

7. Governing Law

These terms shall be governed by the laws of Andalucia, Spain.
